2011 Legislation
The Division of Professional Regulation (DPR) has gotten legislation implemented as follows
House Bill 457
This mandates that professionals receive additonal training in recognizing and reporting child abuse. (effective: 8/1/2010) Respiratory Therapists are listed as one of the groups that needs to complete this training.
The DPR has posted a Web Based Training that is available on their website to meet their mandatory requirement. Once logged onto the Delaware Division of Professional Regulation website, you just click Respiratory Care in the list and it launches you to the page with the link for the training. It is titled Child Abuse identification and reporting guidelines for Delaware Medical Providers.
Summary of 2010 Legislation
House Bill 458 requires all persons licensed by the Board of Medical Licensure and Discipline to undergo criminal background checks every ten years. The DPR will notify licensees to how to meet this requirement. (Effective: 7/1/2011)

Discuss Proposed Language for Unlicensed Home Equipment Personnel – Rule 12.0
A discussion was held concerning proposed language for unlicensed home equipment personnel. Input was requested from Council members as to how they wished to proceed. Council will not establish a subcommittee at this time but rather keep the existing language in the rules and regulations as written. It was suggested to the public attending that they form a subcommittee and work together to develop proposed language and present it to the Council for review.
Select the Percentage for the Post Renewal Random Audit of Continuing Education
20% of the licensees was the percentage selected for the post renewal random audit and to automatically audit the licensees from the last audit whose records were flagged to be audited for this renewal.
